Tracker (cookie)
The French CNIL uses the term “tracker” to describe what is more commonly known as a cookie, i.e. the reading and/or writing of information on a user terminal, whether on a computer browser, a smartphone, a voice assistant, a connected TV or any other connected object. The GDPR requires the collection of consent before using trackers if they are not strictly necessary for the service requested by the user.
- In France, the CNIL refers to “Cookies, Fingerprinting, Pixels or any other identifiers“.
- In the UK, the ICO talks about “Cookies and similar technologies“.
- In Germany the DSK talks about “Pixel, Fingerprinting-Methods, IP-Adresses, Cookie-IDs, Advertising-IDs or Unique-User-IDs“.
- In Italy, the GPDP refers to “Cookies and other tracking tools (fingerprinting or other passive identifiers)“
In France (only), in the case of audience measurement trackers (cookies), the CNIL allows exemption from the requirement to obtain consent under certain conditions, and therefore the deposit of an analytics tracker without consent.
